‘Rolling Stone’s Sole Source for the False Tale of Rape’ Must Testify in Lawsuit

Jackie Coakley, the former University of Virginia student whose false story of a fraternity gang rape became the subject of a 2014 Rolling Stone story, will now be compelled to tell the truth under oath:
A Virginia judge has ruled that the woman at the center of Rolling Stone’s discredited story about an alleged frat house gang rape must testify as part of a lawsuit against the magazine.
The woman identified only as “Jackie” will be deposed on Thursday by attorneys representing Rolling Stone and Nicole Eramo, the University of Virginia administrator who is suing the magazine and the author of the now-retracted article, Sabrina Rubin Erdely. . . .
Eramo, an associate dean of students at UVA, is suing Rolling Stone and Erdely for defamation over what she says was an unfair portrayal of her as an insensitive campus bureaucrat in the story. She is seeking $7.85 million in damages. . . .
At a hearing held Monday in a Charlottesville, Virginia, Judge Glen E. Conrad denied a motion filed by Jackie’s attorneys to quash the deposition subpoena. . . .
Libby Locke, an attorney for Eramo, said Rolling Stone’s negligence led to her client’s unflattering portrayal.
“Jackie was Rolling Stone’s sole source for the false tale of rape that it recklessly published. There were numerous red flags in Jackie’s account, which should have put Rolling Stone on notice that she was not a credible source for information,” Locke said. “Nevertheless, Rolling Stone was dead set on portraying Dean Eramo as a callous administrator who discouraged Jackie from reporting an assault to police — when in fact, it appears that Jackie knew that her tale of rape would not have stood up under real scrutiny and investigation. Had Rolling Stone done the fact-checking and digging that they were legally and ethically required to do as journalists, Dean Eramo would not have been so wrongfully targeted.” . . .
Rolling Stone also faces a $25 million suit from the UVA fraternity Phi Kappa Psi that was named in the article.
Three former frat members have also filed a suit against Rolling Stone, but have not specified an amount.
The liar Jackie Coakley has tried desperately to avoid telling the truth. Last week, the judge slapped down another one of her pathetic excuses.

The Dean also didn’t appreciate being lied about. Jackie Coakley could destroy Eramo’s career with these kinds of lies. It’s hard enough getting to the position of Dean, but if Eramo ever wants to advance further, that means applying for open positions at other universities. Jackie’s lies, via Rolling Stone, could destroy Eramo with any search committee.

On the other hand, the dean was more than happy to libel an innocent fraternity, and stand passively by when its members were falsely accused of rape… so my sympathy meter for her isn’t budging the needle.
Which illuminates the sad and entirely predictable end result of thuggish progressive tactics – sooner or later they are turned against their wielders. The revolution thirsts for blood and will not be sated. They always end up eating each other.
Sucks to have your reputation besmirched, right dean? You could ask Phi Kappa Psi about that.

Dean Eramo, on the other hand, has had her name smeared all over the MSM since the story broke. She, of all people, knew how fake the allegations were, since she knew that Jackie’s claims in regard to her were false.

The deposition will be done privately but that’s not a problem — civil depositions usually are done privately. If the case makes it to trial and Ms. Eramo’s legal team calls on Ms. Coakley to testify (which they will since her testimony is central to the case), that’s when it’s going to become fun. Ms. Coakley’s lawyers will again object, and this time they just might (based on the contents of the depositions) be able to make a case.
But the damage to Ms. Coakley comes not at trial, but rather at the deposition. She’s under oath — if she lies, she can be prosecuted for perjury. That would certainly happen to you or me if we lied in a deposition; would the court and state prosecutor would go after Ms. Coakley? Depends. But the risk is there, and prosecutors have a strong dislike for perjurers.
I suspect that the following happens:
1 — Ms. Eramo’s team pushes Rolling Stone very hard for a big settlement now as opposed to the risk of an even bigger settlement at trial
2 — Rolling Stone considers whether to go after Ms. Coakley formally and if so, how to get blood from a turnip
3 — Given that Ms. Coakley’s lawyers will have had a heart-to-heart with the young woman about the consequences of perjury, she recants her entire story during the deposition. She’d rather be vilified by Rolling Stone than go to prison.
