Mopery (noun) — “The action of committing a minor or petty offence, such as loitering, etc.; contravention of a trivial or hypothetical law, esp. when used as an excuse to harass or arrest a person against whom no more serious crime can be charged.”

Whenever citing the list of heinous torts alleged against us by lying felon Brett Kimberlin — “malicious prosecution, conspiracy to abuse process, defamation, false light invasion of privacy, harassment, intentional infliction of emotional distress, and stalking” — John Hoge always hastens to add, “Mopery, with intent to lurk.”

Perhaps even aggravated mopery, in the first degree.

Alas, being sued by The World’s Most Evil Pro Se Litigant™ does not spare defendants the hassle and expense of defending ourselves, and so getting this absurd case laughed out of court is far more serious business than these lighthearted jests might suggest.

Ditto, says defendant McCain, as to every other spurious claim in Kimberlin’s suit. Who has harassed, defamed and stalked whom? And who has organized a conspiracy against his enemies? This is why Neal Rauhauser’s confessed role in Kimberlin’s lawsuit is so important.

Perhaps you should ask Patterico what manner of mischief Neal Rauhauser has perpetrated over the years or, for that matter, you should read for yourself what Rauhauser (alias “Stranded Wind”) wrote on July 4, 2011: “Weinergate: Patterico’s Penalization.”

Bad causes attract bad people, and Neal Rauhauser’s association with Brett Kimberlin shows what manner of “progressive” client a disgraced Democrat campaign consultant inevitably finds. Kimberlin’s “accuse the accusers” tactics in the courtroom furnish fuel for online defamation by the army of slanderous sockpuppets that Rauhauser has helped assemble. John Hoge cites a typical example:

I will say that essentially all the “facts” cited by Xenophon are not factual. They are demonstrably false. Of course, this doesn’t surprise me. On multiple occasions, I’ve watched Brett Kimberlin lie in court, so why would I expect him or his lackeys to tell the truth any place else.
I’ll make sure that Xenophon’s post gets archived and forwarded to my lawyers.

Tell the truth about Brett Kimberlin, and he then enlists liars like Rauhauser and “Xenophon” to lie about you. The lies that have been endlessly repeated about me, I will not specify here, but the purpose of such smears is obvious: In order to explain why honest people say bad things about Kimberlin, his army of liars must discredit the truth-tellers. Once you know their motives, their methods make perfect sense.

Can you guess what I don’t plan to do?

One million dollars — that’s the amount of punitive damages that convicted bomber Brett Kimberlin is seeking from myself and four other bloggers in a lawsuit recently filed in Maryland. Kimberlin filed this lawsuit pro se (charging “malicious prosecution, conspiracy to abuse process, defamation, false light invasion of privacy, harassment, intentional infliction of emotional distress, and stalking”) more than two weeks ago, but I haven’t written much about this suit because I haven’t yet retained counsel.
The fact that Democrats and their liberal allies in the media will not condemn Brett Kimberlin has angered me since May 2012, when I first started covering the story . . . Because Kimberlin once claimed to have sold marijuana to Dan Quayle, he was celebrated by many liberals — including Doonesbury cartoonist Gary Trudeau — as a political prisoner of sorts. Liberals ignored the facts about the crimes of which Kimberlin was convicted in 1981 and sentenced to 50 years in federal prison. He eventually served only 17 years of that sentence, and since his release in 2001, Kimberlin has promoted himself as a progressive, an “activist-musician” as the Washington Post’s Monica Hesse called Kimberlin in a 2007 feature profile.
The true story of the “Speedway Bomber” who terrorized an Indiana town, planting a bomb that blew off the leg of a Vietnam veteran, evidently isn’t something the Washington Post considers newsworthy. And neither has the Post shown any interest in Kimberlin’s legal war against blogger Aaron Walker that resulted in Walker being briefly arrested last year and ordered by a Maryland judge to stop writing about Kimberlin. . . .

    The most frustrating thing about this whole lawsuit nonsense is that someone else got top billing among the defendants. You’d think that after all the hard work I put in over the past 16 months, I could have earned a bit more wrath. All that work, and someone else gets to be Moper-in-Chief.

    Sigh.

    It’s almost enough to make me want to sue the jerk.

    I have to admit that if something unpleasant ever happens to BK, I won’t exactly be shedding tears.

    Karma is a bitch, what goes round comes round, and eventually, he will find that out. Even if it is only in the afterlife. (But dear Lord, we’d all really appreciate it if it, the meeting between BK and karma, not the afterlife part, could happen a lot sooner.)

    The unfailing Democrat support for criminals that Stacy
    documents—all because the criminals wear blue
    shirts—is going to get worse. The reason isn’t just because Americans are “going bad.” No, people haven’t changed that much in the short span of time since the Bible was written. It’s because the central control the government has over our lives means we can no longer deal with these sorts of criminals in a straightforward manner.

    It used to be if a man came on your property, set fire to your barn, and tore down a fence, you would ventilate him, bury him, and let the Sheriff know about it afterward. Now we have convicted felons abusing our courts and men and women in uniform who may not carry sidearms on base. Also, everything is now illegal.

    I calmly remind people we are in antebellum times. The level of criminality the left is willing to support, promote, and encourage in their quest to attain power is at an all-time high in the west. And yet they foolishly believe we will dance to their tune as they do their best to provoke war. Sadly for them and their children, they believe they will win any sort of war, and they are not going to stop. If we do not take action, the war will happen, seemingly of its own accord.

    This is why a Convention of the States—something unthinkable to Conservatives only five years ago—has become vitally important. If anyone thinks war will somehow be avoided if we only begin electing more Ted Cruz types I have news for you:

    Reagan’s coalition was a mere thirty years ago. It began to unravel after only a year and a half. By the end of his second term, the Progressive/pragmatist Republicans had completely ended any chance of Restoration.

    The Article Five attempt to Restore the Constitution is our moral duty. Why? Because it would be immoral to refuse the chance to prevent war. And this is where the left completely misreads the situation. The reason we must prevent war is to spare their lives.

    Think of it as asking politely, once.

    Exactly, meeting Karma head does not necessarily entail dying.

    But sometimes it’s hard to believe that there aren’t at least a few people we’d be better off not having to deal with. Folks like BK seem to spend a lot of their life trying to diminish others such that their absence might be a net benefit to the world.

    One can hope that he will have a “come to Jesus” moment and reform, but he and his minions seem to have some issues with Pride, the deadliest of the Deadly Sins, because it’s the one hardest to recognize and ask forgiveness for.

    I’m only licensed to practice in California and the laws may be different in Maryland, but I’m hoping for these similarities:

    Here, if a California resident is sued by an out-of-state person or business or other legal entity, the California resident can ask the court to make the out-of-state plaintiff post a bond with the court to pay for the defendant’s court costs in case the California resident successfully defends the lawsuit and is entitled to an award of court costs.

    Also, any party can file and serve a formal offer to settle (for example, a defendant can offer to waive court costs in exchange for an immediate dismissal of all claims.) If that formal offer is not accepted within 30 days but the rejecting party does not get a better Judgment, then the party that offered to settle is entitled to attorneys fees, expert witness fees and other litigation costs on top of court costs.

    Additionally, there are a BUNCH of unpleasant things a competent lawyer can do to people who file frivolous, meritless lawsuits, not only seeking punitive and compensatory money sanctions against the wrongdoing party and their attorney but also suing them for abuse of process, malicious prosecution, intentional infliction of emotional distress, defamation, conspiracy and (my personal favorite) RICO violations per the Racketeer Influenced and Corrupt Organizations Act. So fun!
