9th Circuit Court Of Appeals (Hello, S.F!) Denies Gov. Brewer

There just isn’t any way to avoid politicizing justice on this one. Bolton looked a tool for granting the injunction, the 9th Circuit looks a full-on toolbox.

One hopes, for the sake of everyone, that the scofflaws take a break from scoffing at the law until after the election. It isn’t going to be any fun for some hypothetical crime to happen involving illegal immigrants, and then have to endure the finger pointing.

Update: Stogie (who is beset by challenges) links to a righteous rant on the topic.

Update II: Was Judge Bolton just a little too happy?

Yeah well. Procedures, procedures. As much as I’d like it expedited, this will do. Just more time to bang the drum, and closer to the election, too. This will go our way, the law and facts are on our side. The left (yes YOU y4e), can only bang the table.

Over the last quarter of a century, the 9th Circuit has been reversed by the Supreme Court more than any other Circuit.

Not only that, but they have been reversed more than ALL the other Circuits – COMBINED. They are the loony leftist laughingstocks of Law.

There is no basis in actual law – either statute or controlling case law – for either Bolton’s ruling or the 9th’s. Again, though, elections do matter. Now Obama can punt the decision past November in all likelihood, unless the AZ appellate attorneys can convince the SCOTUS an emergency exists. I can’t remember which Justice oversees the 9th; that could make all the difference.

SB 1070 is one more prohibition enforcement law among many. It is no more likely to reduce crime than it is likely for the John Michael Montgomery to start touring in North Korea.

I don’t live on the Mexican border but I do live in Phoenix, Arizona.
