Excuse me if  I fail to see how a Harvard Law diploma qualifies Elena Kagan to draft a medical paper on partial-birth abortion:

It seems that the most important statement in the famous position paper of the American College of Obstetricians and Gynecologists—a 1996 document that was central to the case of partial-birth-abortion defenders for the subsequent decade and played a major role in a number of court cases and political battles—was drafted not by an impartial committee of physicians, as both ACOG and the pro-abortion lobby claimed for years, but by Elena Kagan, who was then the deputy assistant to the president for domestic policy.

    Her substitute language clearly changed the impression of the group’s conclusion to the opposite – they had found no circumstance under which the “DX” procedure was necessary; she substituted language which said instead that it might “in a particular case be the only” way to safeguard the mother’s life or health, which nothing supports.

    Why did they accept the change? Because although their original study wasn’t biased, their membership was (at least the committee writing the summary), and regretted the finding which would hurt the PBA case.

    This combined with her hilarious attempt to respond to Coburn’s inquiry about Congress mandating Americans eat their veggies every day clearly demonstrate her lack of qualifications, and in fact are or should be disqualifying on their face.

    Unfortunately, if we successfully filibuster Kagan, Obama will double down with an even more radical nominee, figuring we can’t filibuster two without the public seeing us as just obstructing – but if we did, he’d send up an even worse third nominee, and so on. This guy doesn’t quit. He was indoctrinated with Marxist philosophy from an early age and was never exposed to anything or anyone which might challenge his world view, so he “furthers the revolution” any way he can at every turn.

    That is okay, they did not surrender the Alamo when they didn’t have the “votes.” She should be grilled hard to expose where she is coming from and then people who disagree with her should vote against her. Unfortunately, given the current make up of the senate, it will not be enough.

    There are just too many lefties in office who do not get why we find cases like Wickard and Kelo offensive. Who really believe that the reason people are pro life is because they want to control women–and do not get that it is about protecting human beings. Who think gun rights are a sick obsession. Who saddly believe that displays of patriotism are just a step removed from fascism.

    Kagan will prove to be a poor vote on the Court, just like Sotomayor has shown herself to be, but I do not think she is the type of person who would be more effective than her predecessor.

    Elections matter and it is critically important we take control of Congress and the Presidency to prevent Obama appointing more justices.

    If we filibuster every hard left nominee Obama puts up eventually he’ll have put up someone more moderate. Ginsberg has been in poor health and just lost her husband (RIP). Statistics are not in her favor. Even if we wind up having to acquiesce to a second or third choice even worse than Kagan so what. How much worse than Stevens can they be? At this point the Social Democrats are convinced that the Republicans will not filibuster on principal.I agree. This is a weakness not a strength. Tit for tat is a perfectly acceptable way of dealing with opponents. Knowing that Republicans are willing to filibuster just to be obstructionist would do wonders for the right’s moral, even if it had no effect on the left’s way of thinking. There is an attitude on much of the Right that we must be “Better than they are” I submit that we MUST be Better at it than they are.

    I am for filibustering if you have the balls to filibuster. A half assed filibustering is worse than saving that for, God forbid, something happens to Nino, Clarence, Anthony, John or Sam. Again, I am for it but I do not think they have enough committed sentators right now to do it.
